These Terms of Service ("Terms") govern your access to and use of the Tinkerblox website. Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Definitions

  • "Tinkerblox," "we," "us" and "our" mean Tinkerblox Inc.

  • "Site" means tinkerblox.ai, its subdomains, and every page, form and download made available through it.

  • "Content" means all text, graphics, diagrams, benchmark data, workload scenarios, logos and other material on the Site.

  • "Products" means Tinkerblox software and services, including the Tinkerblox execution layer, the MicroPac packager, the installer, documentation and any pilot or production deployment.

  • "Product Agreement" means the Tinkerblox End User License Agreement ("EULA"), an order form, a pilot agreement or any other written agreement signed between you and Tinkerblox.

  • "Submission" means any information you send through the Site, including pilot requests, environment details, job applications and Feedback.

  • "You" means the individual using the Site and, where applicable, the organization on whose behalf that individual acts.

2. Acceptance and Eligibility

2.1 Acceptance. You accept these Terms by accessing or using the Site.

2.2 Business use. The Site is intended for business and professional audiences. You must be at least 18 years old to use the Site or make a Submission.

2.3 Authority. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Relationship to Product Agreements

3.1 Site only. These Terms cover the Site. They do not grant any right to use the Products.

3.2 Products. Access to and use of the Products is governed solely by the applicable Product Agreement. If a Product Agreement conflicts with these Terms, the Product Agreement controls for that Product.

3.3 No commitment. Information on the Site, including descriptions of pilots, onboarding steps and timelines, does not create an offer or obligation unless set out in a signed Product Agreement.

4. License to Use the Site

Subject to these Terms, Tinkerblox grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable right to access and view the Site and its Content for your internal evaluation of Tinkerblox and its Products. All rights not expressly granted are reserved.

5. Restrictions on Use

You will not, and will not permit anyone else to:

  • use the Site in breach of any applicable law or regulation;

  • copy, scrape, crawl, harvest or index the Site by automated means, other than search engines indexing public pages;

  • probe, scan or test the Site for vulnerabilities, or breach or circumvent any security or authentication measure, without our prior written consent;

  • interfere with or disrupt the Site, its hosting or networks, including by introducing viruses, malware or other harmful code;

  • reverse engineer, decompile or disassemble any software or file made available through the Site, except to the extent the law expressly permits;

  • use the Content, benchmark data or workload results to build a competing product, or publish comparisons that misrepresent them;

  • use the Tinkerblox name or marks in a way that implies endorsement, sponsorship or affiliation; or

  • submit false information, impersonate any person or organization, or misrepresent your affiliation.

6. Title and Intellectual Property Rights

6.1 Ownership. The Site and Content, and all intellectual property rights in them, are owned by Tinkerblox or its licensors. No title or ownership passes to you.

6.2 Trademarks. "Tinkerblox," the Tinkerblox logo and our Product names are trademarks of Tinkerblox Inc.

6.3 Third-party marks. Names of third-party hardware, software and platforms that appear on the Site belong to their respective owners. Their appearance describes compatibility or test environments and does not imply endorsement.

7. Submissions

7.1 Pilot requests. When you use "Book a Pilot" or the contact form, you may share your type of business, hardware architecture (x86 or Arm), operating system, orchestration (Kubernetes or Slurm), scale and other details about your environment. You represent that this information is accurate and that you are permitted to share it.

7.2 What not to submit. Do not submit passwords, credentials, secrets, customer data, regulated personal data, or any information you are not authorized to disclose.

7.3 No contract formed. A Submission does not create a contract. Pilot plans, pricing, success criteria and the handling of benchmark results are agreed only in a signed Product Agreement.

7.4 Careers. Applying for a role does not create an offer or an employment relationship.

7.5 Feedback. If you give us suggestions or ideas about Tinkerblox or the Products ("Feedback"), you grant Tinkerblox a perpetual, irrevocable, royalty-free right to use it for any purpose without obligation to you.

7.6 Privacy. We handle personal data in Submissions as described in our Privacy Policy.

8. Performance Information and Benchmarks

The Site presents performance results, including lower infrastructure hours, faster pod startup, higher throughput per node, token-yield improvement and reduced energy consumption. These results come from specific pilot environments with particular CPU and GPU configurations.

  • They are illustrative and are not a guarantee of results in your environment.

  • Actual results depend on your hardware, software, workloads, orchestration, configuration and baseline.

  • Some figures may be estimates or may change without notice.

  • Any performance commitment binds Tinkerblox only if written into a signed Product Agreement.

9. Third-Party Sites and Services

The Site links to or relies on services we do not control, including LinkedIn, X (Twitter), GitHub, Discord and Framer, the platform that hosts the Site and processes its forms. Those services are governed by their own terms and privacy policies. Tinkerblox is not responsible for their content, availability or practices, and your use of them is at your own risk.

10. Privacy and Cookies

Our Privacy Policy and Cookie Policy describe how we collect and use information through the Site. They form part of these Terms.

11. Export Controls and Sanctions

You may not access the Site, or download any material from it, in breach of U.S. or other applicable export control or sanctions laws. You represent that you are not located in a comprehensively sanctioned country or region and are not on any U.S. government restricted-party list.

12. Disclaimer of Warranties

THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINKERBLOX DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. TINKERBLOX DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY CONTENT, INCLUDING PERFORMANCE FIGURES, IS COMPLETE OR CURRENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TINKERBLOX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TINKERBLOX'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain exclusions or limits, so parts of this Section may not apply to you.

14. Indemnification

You will defend, indemnify and hold harmless Tinkerblox and its officers, directors, employees and agents from any third-party claim, loss, liability or expense, including reasonable legal fees, arising from (a) your breach of these Terms, (b) your Submissions, or (c) your misuse of the Site.

15. Suspension and Termination

We may suspend or end your access to the Site at any time, without notice, if we reasonably believe you have breached Sections 5, 7.2 or 11. Sections 6, 7.5, 8 and 12 through 18 survive termination.

16. Changes to the Site and These Terms

We may modify, suspend or discontinue any part of the Site at any time. We may update these Terms by posting a revised version with a new effective date. Your continued use of the Site after that date means you accept the revised Terms.

17. General Terms

17.1 Governing law and jurisdiction. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in Santa Clara County, California have exclusive jurisdiction over any dispute relating to the Site, and you consent to their jurisdiction.

17.2 Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in effect.

17.3 No waiver. Our failure to enforce any provision is not a waiver of it.

17.4 Force majeure. Tinkerblox is not liable for any failure or delay caused by events beyond its reasonable control.

17.5 Independent parties. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship.

17.6 Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or a successor in a merger, acquisition or sale of assets.

17.7 Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and Tinkerblox about the Site.

17.8 Notices. We may give notices by posting them on the Site or by email to an address you provided. You may send notices to us through the contact details in Section 18.
